Terms of Service — physmat.org

These Terms govern your use of physmat.org (the "platform", "service", "we", "us"). They should be read alongside our Privacy Policy, our Children's Privacy Notice, our Acceptable Use Policy, our AI Tutor Notice, our Sale & Cancellation Terms and our Refund Policy. Where these Terms touch how we handle personal data, the Privacy Policy governs.

This service is offered in the United Kingdom. It is not offered in the United States at this time, and we do not target US users.

1. Who we are

The platform is operated by to be confirmed, a company registered in England and Wales (company number to be confirmed), registered office to be confirmed. General contact: mail@physmat.org.

2. Who may use the platform (eligibility)

The platform is used by children to practise mathematics, with accounts created and managed by a responsible adult:

• Parent flow. A parent or guardian creates and manages an account for their child. The parent is responsible for the child's use of the service.
• School flow. A school enrols its pupils and manages their accounts. The school is responsible for its pupils' use of the service in that setting.

A child uses the service under the responsibility of the parent or school who created the account. A child does not independently enter into these Terms; the adult who creates the account does so on the child's behalf and agrees to these Terms.

3. Roles — who is responsible for personal data

How personal data is handled, and who is the controller, is set out in the Privacy Policy §1. In short: where a parent signs up directly we act as the controller; where a school enrols its pupils, the school is the controller and we act as the school's processor under a written School Data Processing Agreement.

4. The service

• Core service. The problem bank (a curated bank of mathematics problems) together with answer submission and grading is the core of the platform. This is what every account gets.
• AI tutor (optional, paid, opt-in). The AI tutor is an optional add-on that a parent chooses and pays for; it is off until purchased and is access-gated. A child can use the platform fully without it. What the tutor is, what it sends to the AI model, and its limitations are described in the AI Tutor Notice and the Privacy Policy §5. The tutor is an AI helper, not a person, and its output may be wrong.
• Adaptive practice (the "picker"). Adaptive practice is off by default and is only used if a parent or child turns it on. See the Privacy Policy §4.

No guarantee of outcomes. The platform is a study aid. We do not guarantee any specific educational result, exam outcome, grade, or level of improvement.

5. Accounts and security

• Keep account credentials confidential and do not share them. You are responsible for activity under an account you control.
• A parent or school manages the child accounts they create — including provisioning, oversight, and (where applicable) deletion.
• Tell us promptly if you believe an account has been accessed without authorisation: mail@physmat.org.
• We protect accounts with the security measures described in the Privacy Policy §11. No system is perfectly secure.

6. Acceptable use

Your use of the platform must comply with our Acceptable Use Policy, which prohibits (among other things) misuse of the service, and any copying, scraping, or redistribution of our content (see §9). Breach of the Acceptable Use Policy is a breach of these Terms.

7. Payments and subscriptions

• Paid features (such as the AI tutor) are sold on a subscription basis and paid for through Stripe. Card details are entered with Stripe; we never see or store card numbers — we hold only Stripe identifiers and the status of a subscription (see Privacy Policy §6).
• The terms of sale, the right to cancel, the subscription lifecycle, and refunds are governed by the Sale & Cancellation Terms and the Refund Policy, which form part of your agreement with us when you buy a paid feature.
• Your statutory rights as a consumer are preserved and are not affected by these Terms.

8. User content

• A child's answer submissions and AI-tutor inputs are personal data and are handled as described in the Privacy Policy (see §3, §5 and §8 there for what is stored, what is sent to the model, and who can see it).
• We do not claim ownership of what a child types into the platform.
• To operate, store, grade, secure and back up the service, you grant us a limited, non-exclusive licence to use that input only for the purpose of providing and securing the service to you.

9. Our intellectual property

The problem bank, all problems, solutions, content, branding, software and the platform itself are owned by us or our licensors and are protected by intellectual-property law. You may use them only to use the service as intended. You must not copy, scrape, harvest, republish, resell or redistribute any part of the platform or its content, in whole or in part, except as expressly permitted. This is reinforced by the Acceptable Use Policy.

10. Availability, changes, and disclaimers

• We aim to keep the platform available but do not guarantee uninterrupted or error-free operation; we may carry out maintenance, and we may change, add, or withdraw features.
• The platform and its content are provided "as is" to the extent permitted by law. The AI tutor in particular is an automated helper and its output may be inaccurate; it does not replace a teacher.
• Nothing in this section limits rights you have that cannot be limited by law (see §11).

11. Liability

• We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for any rights you have as a consumer that cannot be excluded under law (including under the Consumer Rights Act 2015).
• Subject to the above, our total liability to you in connection with the service is capped at the fees you paid in the 12 months preceding the event giving rise to the claim.
• Subject to the above, we are not liable for loss that was not reasonably foreseeable, or for outcomes that depend on a child's own study (the platform does not guarantee educational results — see §4).

Your statutory consumer rights are unaffected by this section.

12. Suspension and termination

• We may suspend or terminate access to the platform (or to a paid feature) if these Terms or the Acceptable Use Policy are breached, or where we must do so to protect users (including for safeguarding reasons — see the Safeguarding Statement) or to comply with law.
• A parent or school may stop using the service and delete an account at any time. What happens to data on deletion — soft-deletion, anonymisation of identifying fields, and the retention of an immutable consent/audit record — is described in the Privacy Policy §9. Ending a paid subscription is governed by the Sale & Cancellation Terms.
• We never send marketing to a child's account, and marketing to parents is only ever with explicit opt-in consent that can be withdrawn at any time (see Privacy Policy §4).

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. Your statutory rights as a consumer, including the right to bring proceedings in your country of residence where that right applies, are unaffected.

14. Changes to these Terms

We may update these Terms. If we make a material change, we will tell affected users in an age-appropriate way before it takes effect. The "last updated" date at the top shows the current version.
